1. Purpose and Scope
These Terms & Conditions (“Terms”) govern:
Access and use of the website www.memorabiliamatchworn.com (the “Platform”)
Account creation and participation in auctions
Purchase of fixed-price products
Delivery, returns, and customer rights
Legal relationship between the user (“you”, “the User”) and Memorabilia Match Worn, S.L.
By accessing or using the Platform, you agree to these Terms and to all applicable Spanish and EU laws.
If you do not agree, you must stop using the Platform immediately.

3. Eligibility and Account Registration
3.1 Eligibility
You must be:
At least 18 years old, and
Capable of entering into legally binding agreements.
3.2 Account Creation
To bid or purchase, you must create an account providing accurate and complete information.
You agree to:
Keep your information updated,
Maintain confidentiality of your login credentials,
Be responsible for all activity under your account.
MMW may suspend or close accounts when detecting fraud, misuse, or breach of these Terms.
4. Use of the Platform
You agree to use the Platform lawfully and to refrain from:
Interfering with auctions or using automated bidding tools/bots
Creating fake accounts or impersonating others
Uploading malicious code, viruses, or performing attacks
Manipulating prices or engaging in fraudulent behaviour
Violating third-party intellectual property rights
We may suspend, restrict or terminate access for misconduct.
5. Products and Descriptions
The Platform offers:
Match-worn items,
Sports memorabilia,
Collectibles,
sold either by MMW or by approved third-party sellers (“Sellers”).
5.1 Condition of Products
Due to the nature of match-worn items:
Products may present wear, stains, damage or signs of use
Colours in images may vary from real appearance
Product descriptions are indicative and not exhaustive
Products are sold “as is”, without prejudice to your mandatory consumer rights.
6. Authenticity Guarantee
MMW guarantees that Products sold directly by MMW are authentic.
If you reasonably believe a Product is not authentic, you may request a refund within 14 days of delivery, subject to:
Returning the item in the same condition
Providing reasonable supporting evidence
This guarantee applies only to the original buyer.
7. Auctions
7.1 Bidding Rules
Bids are binding, final, and cannot be withdrawn
Each new bid must exceed the previous one
Last-minute bids may extend auction time
The highest valid bid at closing wins
7.2 Auction Adjustments
MMW may cancel, modify, or restart an auction in case of:
Fraud suspicion
Technical errors
Operational issues
Partner or logistics problems
8. Purchases and Payment
8.1 Fixed-Price Products
Clicking “Order & Pay” constitutes a binding offer to purchase.
8.2 Purchase Price Includes:
Product price
Buyer’s premium (if applicable)
Shipping and handling
Taxes (Spanish VAT or other applicable taxes)
Payment method fees (if any)
Customs duties (payable by the buyer where applicable)
8.3 Payment Deadline
You must complete payment within 48 hours of order confirmation.
Failure to pay may result in:
Cancellation of the order
Suspension of your account
Relisting the item
Administrative fees where legally allowed
9. Shipping and Delivery
9.1 Shipping
Products are shipped to the address provided in your account.
You are responsible for:
Providing a correct delivery address
Complying with import laws in your country
Paying customs duties or charges (if applicable)
9.2 Delivery Times
We aim to ship within a reasonable timeframe; delays may occur due to logistics or customs.
9.3 Transfer of Risk
Risk passes to you upon delivery to the address provided.
9.4 Failure to Accept Delivery
If you fail to receive the package, you may incur:
Storage costs
Re-delivery fees
MMW may cancel the order if delivery cannot be completed.
10. Returns, Cancellations & Consumer Rights
10.1 Due to the nature of the items:
Returns for “change of mind” are not accepted.
Match-worn items are unique, personalised and used, and fall under exceptions in EU consumer law.
10.2 Defective Products
If the item is defective (not related to expected wear from use), you may contact us within 3 days of delivery.
Your statutory rights under Spanish consumer law always apply.
11. Prices, Taxes & Currency
Prices may appear in several currencies but are charged in the currency selected at payment.
Taxes will be displayed at checkout.
If VAT rules require adjustment, the final amount will reflect legal requirements.
12. Intellectual Property
All content, trademarks, logos, text, images, and software on the Platform belong to MMW or its partners.
You may not:
Copy, modify, distribute, or exploit any content
Use our trademarks without prior written consent
13. Third-Party Sellers
Some Products may be listed and sold by external Sellers.
Where applicable:
Their identity will be shown on the Product page
Specific terms may apply in addition to these Terms
14. Third-Party Services
The Platform may integrate external services (payment providers, logistics, etc.).
MMW is not responsible for their terms, performance or policies.
15. Liability
To the extent allowed by Spanish law:
The Platform and Products are provided “as is”
MMW is not liable for indirect damages (e.g., loss of profits, lost opportunities)
Our maximum liability is limited to the amount you paid for the Product in dispute
Nothing in these Terms excludes liability where it cannot be excluded under Spanish law (fraud, gross negligence, mandatory consumer protections).
16. Data Protection
We process personal data in accordance with:
GDPR (EU Regulation 2016/679)
LOPDGDD (Spanish Data Protection Law)
17. Changes to the Terms
We may update these Terms at any time.
The version in force at the time of your purchase or use of the Platform will apply.
18. Governing Law and Jurisdiction
These Terms are governed by Spanish law.
Disputes will be submitted to the courts of Madrid, except where EU consumer law grants jurisdiction to the courts of your residence.
